Court Dissolves Temporary Restraining Order, SpamCop Allowed to Continue to Report Complaints of spam From Optinrealbig.com

SAN BRUNO, Calif. – May 12, 2004 – IronPort Systems, the world’s leading email infrastructure products and services company, today reports that the temporary restraining order against SpamCop.net, a wholly-owned subsidiary of IronPort Systems, Inc has been dissolved. SpamCop.net, a wholly-owned subsidiary of IronPort Systems, Inc., is an interactive Internet-based service that helps individuals and Internet Service Providers (ISPs) reduce unsolicited email, or “spam,” by forwarding complaints of spam to ISPs taken advantage of by spammers. SpamCop.net has been sued by Optinrealbig.com, and its self-proclaimed “King of spam” CEO Scott Richter, who seeks to silence the anti-spam community.

On May 10, 2004, the United States District Court, Northern District of California, the Honorable Saundra Brown Armstrong of the Northern District of California granted Optinrealbig’s ex parte application for a temporary restraining order against SpamCop. The TRO was presented and considered ex parte, meaning Optinrealbig’s application was decided without the benefit of receiving argument or evidence from SpamCop. May 11, 2004, after considering SpamCop’s opposition papers, the Court issued an order dissolving yesterday’s TRO. In so doing, the Court cited the fact that yesterday’s order and SpamCop’s opposition “crossed each other in the e-filing system,” and expressly found that “the balance of hardships and the interests of justice favor dissolution of the TRO.” The Court further wrote to “clarify that the TRO [entered May 10] was not a determination of the merits of the case.” SpamCop is gratified by the expedited consideration of its papers and the order entered today by Judge Armstrong.
