I hope Spamhaus sees this, actually this is a good decision for all blocklists.

Interesting to note that the judge in this case was the same one who handed down a decision in favor of the (alleged) spammer in Gordon v. Virtumundo. It seems that anti-spam plaintiffs should not assume that God Is On Their Side, and should be sure to present clear and unimpeachable arguments on their behalf (as Spamhaus failed to do apparently in their first tussle with Linhardt).

Prezac'ly and it is ever thus. Any judge considering information or knowledge not specifically presented in proceedings is just asking for the affected decision to be overturned on appeal (and, quite rightly, it would be). Accordingly "hizzoner" is assumed to be as innocent as a new-born babe when it comes to "the ways of the world". Mind you, that's a bit of a stretch when you consider some of them, apropos of which ("stretching") that one sacked for fiddling under his robes with the pump thing awhiles back was definitely straining credibility and the ready acceptance of "judicial innocence" - and perhaps more if he actually got it attached. Now *he* would have been a bad one for a spam trial.
