If I were you, I would contact abuse[at]gnax.net, abuse[at]topinnovative.com, abuse[at]dnsprotect.com, abuse[at]theplanet.com, my lawyer, and possibly abuse[at]level3.net. Perhaps you both are using the same supplier? Comparitive data posted here .. sort out your data, make notes on their data then start talking to ISPs involved if you want.
